PMDG Forum Rules

1) SIGN YOUR POSTS. Since 1997, we have asked users to sign their real name, first and last, to all posts in the PMDG forum. We do this in order to keep conversations personal and familiar. You took the time to be here, we want to get to know you. This is one of the few rigid rules that we enforce regularly. We do so because we feel that forums in which users must engage one another personally are generally warmer, more collegial and friendly. Posts that are unsigned will be quietly removed without comment by the moderators, so to make your life easy- we recommend enabling your forum signature so that you never need to remember. Do this by clicking the username pull-down at the top right, then selecting "User Settings." You will find the signature editor on the ACCOUNT tab, about half way down the page. Look for "Edit Post Signature." Be sure to click the "Show Signatures" box.

2) BE NICE. We are all simmers here and no matter our differences of opinion, we share a common love of aviation, computing and simulation. Treat everyone else in the forum with respect even when you disagree. If someone frustrates you, walk away from the conversation or ask for a moderator to get involved. Speaking of Moderators, they prefer not to be treated as "The Thought Police" but if any behavior infringes on the enjoyment of another user or is otherwise considered to be unacceptable in the moderator's judgment, it will be addressed in keeping with our view of ensuring that this forum remains a healthy environment for all simmers.

3) BE LAWFUL: Any behavior that infringes upon the law, such as discussion or solicitation of piracy, threats, intimidation or abuse will be handled unsympathetically by the moderators. Threats and intimidation may, at the moderator's discretion, be provided to law enforcement for handling.

4) BE FACTUAL: When you post, always be factual. Moderators will remove posts that are determined not to be factually accurate.

5) RESPECT COPYRIGHTS: Posting of copyrighted material such as flight manuals owned by Boeing or various airlines is not allowed in this forum. If you have questions related to copyrighted material, please contact a forum moderator for clarification.

6) RESPECT PMDG: We love to hear what you like about our products. We also like to hear what you think can be improved, or what isn't working. Please do tell us and we will always treat your feedback with value. Just be sure to treat the team respectfully, as they do put a significant amount of effort into building and maintaining these great simulation products for you.

7) RESPECT PMDG DEVELOPERS: All of the developers will spend some time here. Given the ratio of developers-to-users, it simply isn't possible for us to answer every post and private message individually. Please know that we do try to read everything, but developer workload is simply too high to manage personal contact with tens-of-thousands of users simultaneously. In most cases, members of the development team will stick to conversations in the forum and will not answer private messages.

8) RESPECT OTHER DEVELOPERS: PMDG has always advocated for a strong development community and we have many friends within this community. Every developer offers something unique that helps to make the simming community larger and more vibrant. We insist that you treat our friends respectfully.

9) RESPECT MODERATORS: Moderators have a tough job, and none of them enjoy having to stomp out negativity. If a moderator has to weigh in to keep a thread peaceful, please respect that effort and refrain from giving the moderator any grief.

11) This forum is designed primarily as a vehicle for the PMDG development team to interact with our customers, and for customers to interact with one another in a manner that is positive, supportive and assists in the general advancement of understanding the simulation and helping to make this and future simulations better. Any other use of this forum is not permitted, including but not limited to discussion of pricing policies, business practices, forum moderating policies, advertising of non-PMDG products, promotion of events, services or products that are not approved in advance by PMDG or any other topic deemed unacceptable by any forum administrator

    [23JUN22] EULA Updates to make life simpler for Modders/Tinkerers

    Captains,

    Commensurate with the update we published today for the PMDG 737-700, we are making a global change to our End User License Agreement. This change is in effect immediately and covers our entire product line retroactively.

    The short version:
    Beginning today, anyone wishing to create texture/artwork mods for their PMDG product is able to do so and may also distribute them as freeware. This should end a rather unpopular and contentious requirement that constantly had us filing DMCA takedown requests when someone would fail to follow the older EULA which limited modifications to only the creation of liveries

    Our hope is that this will bring some relief to the creators out there who enjoy being able to mod their sim but also want to share their creativity with the community.


    The Long Version:
    Back in the mid-late 2000s, PMDG became subject to a license agreement that allowed us to use certain intellectual property not belonging to PMDG, but it also had very strict guidelines about things we could not allow to be done with our products. Those who were participating in the simming hobby will recall that the post September 11 simming world was a bit more tense and "legal" than it is now- and beginning in 2008, PMDG had some pretty rigid restrictions by which we had to adhere in order to maintain our license with Boeing. (In the very beginning, for example, we even had to argue on behalf of allowing the creation of liveries as the initial agreement prohibited this.. Just imagine! )

    We really haven't revisited these restrictions in a dozen years, mostly because the much smaller (and lets be honest, shrinking) simmer community had been with us through the transition period and understood why we were required to only allow livery creator modifications. Everyone adapted and it met the needs of the time.

    With the change to MSFS, the simming community has grown exponentially and now is made up largely of folks coming to the simming community from elsewhere in the gaming sphere where norms and expectations are different when it comes to modding. Some of these expectations ran into our limiting EULA requirements and this has created some drama as we have continued to enforce our EULA as required to maintain our license.

    We have had a series of calls and discussions over the past couple of weeks aimed at giving us some wiggle room that would allow modders and tinkerers the chance to share their creativity. It has taken a bit of work, and we even recruited a couple of folks who had reached out to us for permission (as required under the previous EULA) and their input and examples of their work were used to demonstrate that the creativity that comes from the user community need not be viewed as a source of potential risk, but instead as a source of creativity.

    I am happy to report that the re-approach on this topic worked, and this has allowed our counsel to re-write our EULA to make it much more friendly for modders.

    I would like to thank Mike, Charles and Briney for their participation in the intellectual exercise that allowed us to make this change. You guys had a great sense of humor and offered thoughtful insight in a manner that was really useful to us in making our case. I much appreciated the insight and the discussion, as it helped to shape the argument we used in opening this issue up for discussion. We didn't expect to get an affirmative answer this quickly, but I think using you guys as an example really helped. Given the pace with which these sorts of discussions usually move, we kicked off this effort in hopes we'd have an approval in time for release of the 737-800 in August- so the changing being authorized today came as a bit of a surprise on our end.

    There is still a tripwire to beware of, here:
    If you are a skilled modder and want to do anything outside of textures/artwork- we do still require that you hit us up for permission before distributing any creation that involves modified versions of our models, sounds or other files. This requirement comes from some complicated case-law in intellectual property that can cause the owner of intellectual property (PMDG, in this case) to lose control of their IP if they are shown not to be defending their ownership of same. The simple way for us to avoid this is to thank you for reaching out, offer you a worldwide, royalty free license to distribute your mod, and off you go. A number of users have done this over the years and it works really simply.

    What if you have a previous mod you created that got hit with a DMCA takedown?:
    Sorry. Until we received relief from the strict requirements late this afternoon, we had to stick to the letter of the requirements. The good news is that *provided your mode is artwork/texture based* you are now free to do as you like and don't need our input at all.

      I'm very disappointed Rob. I had you pegged for a villan...complete with a handlebar mustache you twisted as you plotted your evil plans to destroy freeware modder's ambitions all over the web, with a propensity to tie up women named Nell and lay them on railroad tracks!

      A lot of internet spots simmers like to hang out at have just lost about 30% of their message traffic about your villainous ways...they will probably come after you and try to sue PMDG for losing some advertisers, LOL.

        As others have said - credit where credit is due. I may not still agree with everything I see, but I applaud this change. To me, this feels like a good-faith effort to rewrite your company policies and legal procedures to become more open, friendlier, and ready to welcome the creativity of this community with arms wide open. Thank you for listening to the feedback and advocating for your customers to build a more open agreement that allows us all to enjoy the hobby of flight sim even more!

            Hey MarkusGX, I'm not officially a PMDG member, I'm just a beta tester....not much a level higher than a member. Sure we get a fancy logo to pin on our shoulder epaulettes, but not much more. Kevin is probably right regarding the rules, he's on this forum more than anyone and has probably read the rules in detail....I just brushed over them and got what I needed from them. hehe.
            In the end, Mark has resolved the issue, so I'll get back where I belong...in the dungeon, testing the next build.

            Bravo RSR and PMDG team! I can see right here PMDG wants to and is willing to work with the flight sim community, not fight it like many threads going around away from here have stated. What an about face and so warmly received. Bravo! Thank you PMDG. Two thumbs up.
